Sanctum patrol army still alive

I manually fought a battle with a sanctum patrol army and lost, but the army was still a
live with the lord having 0 traits. I am running with 2 minor mods, but the mods are the battle standard bearer mod and the better camera mod, neither of which should have any effect on this issue.
v1.12.0 build

The quick save is before the battle, the Appears behind you save is after the battle

upon further playing, i have now found that manually fighting the battle at all will make the army stay? is this intentional?
