Archeon can't vassalize daemons of chaos last Settlement

I can't force vassalize the daemons of chaos after attacking their last settlement, vassal option is in diplomacy but not in last settlement defeat options. Their last settlement was a minor settlement and they had an army just out side the city.
Is this suppose to be this way or an over site?
